User Agreement

This User Agreement states the general terms and conditions applicable to the use of our services available under the domain name of www.ukno.1.co.uk (“We”/“Us” and/or “Website”) (“User Agreement”).

This User Agreement is effective for new registered Users from the 02 August 2005.  The Website reserves the right to amend the User Agreement from time to time and the User of this Website (“You”) will be provided with notice of any change by a general notice posted on the website.  Any amended User Agreement shall regulate new users and exisiting users from the date the amended User Agreement was posted on the Website.

Introduction

This Website is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise You to understand all of these terms before joining.  If You spot a listing that You feel is violating the general terms and conditions of the Website as stated below please let Us know by contacting Us.

Rights To Suspend or Terminate

You agree that this Website, in its own discretion, may terminate any auction or use of the service immediately and without notice if

(a)    We believe that You are not abiding by the general rules of this Website;

(b)   You have broken a certain term;

(c)    You commit or are about to commit an act of fraud, to include manipulation of any items, information, listings;

(d)   You have listed a suspicious item; and

(e)   We believe You to be a non paying bidder.

In most cases when we suspect foul play We will suspend Your account/listing whilst We investigate further.  If our investigation is conclusive then Your account with Us will be terminated at our sole discretion.  Please note that there is no obligation on Us to undertake any investigations and responsibility of checking bidders and sellers lies with You.

Your Conduct

You are solely responsible for the contents of Your actions through this Website. You must ensure that Your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that You must check that You are entitled to sell or buy the relevant item and that You are not prohibited from doing so by any law or regulation or the terms of this User Agreement.

You must not transmit through the service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.  Please note we have not responsibility or liability for any such transmissions as stated above.

Membership

Membership to this Website is only available to those of You who can form a legally binding contract.  Any suspended members may not use this Website. This Website does not permit under 18’s (“Minors”) to register.  If any member fails to sign up with their correct age the account will be terminated immediately.  Please note that we have no responsibility for checking the age of users on our Website and we accept no liability for any action/omission undertaken by any Minors. We cannot confirm the purported identity of users or the validity of the information which users provide and/or post on our site.

Liability

This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control and do not provide any warranty or guarantee over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of bidders to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.

It is a condition of the Use of this Website that we have no responsibility for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either bidder and/or seller.

We are not responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.   We do not offer any protections from any unsafe items listed for sale on this Website.  Please do not assume that products and/or services are safe to people or property, or legal, and that the accuracy of any statement made by the seller is correct.  You will have sole responsibility for ensuring that bidders and sellers actually complete a transaction and You will also have sole responsibility for the legality of Your actions.

We will not be responsible for any damages You or your business may suffer and we make no warranties of any kind, expressed or implied for services we provide, for any loss of information, products and/or services.  We do not keep a back up of any data and we cannot guarantee to replace any lost or missing information, including non delivery of information, delays, wrong delivery and any interruption to our service which causes you loss.

By using this Website You are agreeing to the terms and conditions of this User Agreement and therefore releasing Us from all claims, liability, damages, losses, costs and expenses, to include legal fees, economic and consequential loss, loss of goodwill and negligence.  You are also agreeing to indemnify Us in relation to any claim made by any third party due to or arising out of Your breach of this User Agreement or Your breach of any law or rights of any third party.

Information

Please note that We have no control over information provided by bidders or sellers.  You may find the information they provide to be offensive, harmful, inaccurate, misrepresentative, fraudulent etc.  By using the Website you are agreeing to accept the terms of the User Agreement and accept any and all risks attached to any information posted by bidders or sellers.

Third Party Rights

Nothing in this Agreement is intended to confer on any person any right to enforce any term of this Agreement which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999.

Severance

If any condition, condition or provision of the User Agreement which is not of a fundamental nature is held to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction in any proceedings relating to the Agreement, such provision shall be severed and the validity or enforceability of the remainder of the Agreement shall not be affected thereby.

Waiver

No failure, delay, relaxation or indulgence by any Party in exercising any right conferred on such Party by this Agreement shall operate as a waiver of such right, nor shall any single or partial exercise of any such right nor any single failure to do so, preclude any other or future exercise of it, or the exercise of any other right under this Agreement.

Laws

This User Agreement shall be governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.

PLEASE NOTE THAT BY USING THIS WEBSITE FOR ANY OF OUR SERVICES YOU AGREE TO BE BOUND BY TERMS AND CONDITIONS OF THE USER AGREEMENT.
